The State of Clean Slate

When the Clean Slate Act passed in 2021, an estimated 290,000+ Delawareans with 590,000+ cases qualified for expungements under the Act. The law went into effect August 1, 2024 and from then through December 31, 2024, Delaware only cleared just over 1,300 cases. For all of 2025, Delaware then cleared only an additional 25,000 charges. At that rate, it would take Delaware over 20 years just to get through the backlog of expungement eligible cases that existed in 2021 when the law passed. Where does Delaware stand now?
